BEREC is organising a workshop on ex ante regulatory experience concerning commitments, wholesale-only undertakings and commercial agreements review on 11 April 2024 from 9:30 to 16:30 CEST.
The EECC introduced, with Art. 76,79 & 80, the possibility to apply light-touch regulation in certain SMP situations with the aim of incentivising the deployment of VHCN. Network access commitments and/or co-investment agreements may be made binding for the identified operators (deemed to have SMP) instead of imposing the typical set of remedies. In 2020, BEREC published guidelines for the consistent application of conditions and (minimum) criteria for the assessment of co-investments in new VHCN ( BoR (20) 232 ). Finally, following the publication of the Gigabit Recommendation, the impact of commercial agreements on market analysis is to be considered during workshop.
BEREC will stimulate a debate among the stakeholders, and between the stakeholders and regulators on the importance of these legal provisions, their application, harmonisation, monitoring, evaluation and related guidance, as well as the effective account of commercially-negotiated wholesale access agreeements in the market analysis done in Europe. Some potential topics of relevance could be the conditions for network sharing obligations, including in the context of 5G network deployments, risk sharing mechanisms for investments in VHCN elements, the potential impact of commercial agreements or fair and reasonable pricing in the case of pure wholesale operators.
