BEREC has adopted a BEREC opinion on a Phase II investigation: Case ES/2013/1466

BEREC adopted a BEREC Opinion on Phase II investigation pursuant to Article 7 of Directive 2002/21/EC as amended by Directive 2009/140/EC on 5 August.

On 27 June 2013 the European Commission informed the Spanish National Regulatory Authority CMT and BEREC about its serious doubts considering that a draft measure concerning the review of prices in the market for wholesale broadband access (market 5) in Spain would create a barrier to the internal market.

Following its role and rules BEREC adopted its opinion, stating that the expressed serious doubts by the European Commission are mostly justified. More specific information about the serious doubts of the European Commission and BEREC’s assessment can be found here.
