Public consultation on the draft BEREC Guidelines on access to in-building infrastructure according to Art.11(6) of the Gigabit Infrastructure Act
Deadline: Friday, 11 July 2025 (CoB)
During the 63rd BEREC plenary meeting (5-6 June 2025), the Board of Regulators approved the Draft BEREC Guidelines on access to in-building infrastructure according to Art.11(6) of the Gigabit Infrastructure Act (BoR (25) 84) for public consultation.
Background
The new Gigabit Infrastructure Act (GIA) entered into force on 11 May 2024 and replaces the Broadband Cost Reduction Directive (BCRD) adopted in 2014. The GIA aims at facilitating and stimulating the roll-out of very high capacity networks (VHCNs) so that such networks can be rolled out faster and at a lower cost, in particular given a growing demand for faster, more reliable data intensive connectivity and as an important tool to achieve the 2030 European Union connectivity targets on gigabit connectivity. In Article 11(6) of the GIA, the co-legislators task the Body of European Regulators for Electronic Communications (BEREC) with the provision of Guidelines by 12 November 2025 on “the terms and conditions of access to in-building physical infrastructure, including on the application of fair and reasonable terms and conditions, and the criteria that the national dispute settlement bodies should follow when settling disputes.”
