Public consultation on the draft BEREC Report on the impact of generative AI on internet openness

During the 68th BEREC ordinary meetings (1-2 October 2026), the Board of Regulators adopted the draft BEREC Report on the impact of generative AI on internet openness [BoR (26) 141] for public consultation.
Background
Generative AI services have spread rapidly in the last five years and have deeply modified our everyday digital activities. Such technology can greatly benefit a variety of different actors, including end and business users, but also national regulatory authorities (NRAs) who increasingly use AI solutions to support their regulatory tasks (e.g. for market surveillance, competition analysis and spectrum management or for knowledge-sharing on AI regulation).
While generative AI can enrich user experience and complement traditional methods of accessing, generating and distributing online content and services, it can also affect the overall user experience on the internet as it has the potential to directly influence the way users access online content/services and possibly, therefore, their freedom of choice. Their widespread integration into a variety of digital services and products (e.g. search engines, messaging services, operating systems etc.) can exacerbate this possibility.
Aim
The draft Report analyses the impact of generative AI on internet openness, meaning the users' ability to access and distribute information, content and services online without unlawful interference or discrimination, and to innovate. The report also examines the evolving structure of the AI ecosystem, the technical protocols that govern interactions between AI systems and online services, the implications for users and content providers, and the extent to which existing European regulatory frameworks can address the resulting challenges.
Submit contributions
Interested stakeholders are kindly requested to submit their contributions via EU survey by 11 November 2026 (CoB).
After submitting the contribution, you will receive an acknowledgement of receipt. If you do not receive this acknowledgement, the contribution was not submitted successfully and should be resubmitted.
Contributions should be sent in English, and, in order to facilitate processing of the responses, the comments provided should clearly refer to certain sections/subsections/paragraphs of the document.
In accordance with the BEREC policy on public consultations, BEREC will publish all contributions and a summary of the contributions, respecting confidentiality requests. In that regard, any request for reduction of the text on confidentiality grounds should clearly indicate which information is considered confidential and be accompanied by a non-confidential version.
We strongly encourage all stakeholders to submit their contributions as early as possible. Contributions received after the above-mentioned deadline will not be taken into account.
