BEREC Report on Stock-taking of NRAs application of Article 52(2) for wholesale access obligations

Article 52(2) from EECC sets out that NRAs/competent authorities shall promote effective competition and avoid distortions of competition in the internal market when deciding to grant, amend or renew rights of use for radio spectrum for electronic communications networks and services, in justified circumstances, attaching conditions to rights of use, such as the provision of wholesale access.

In March 2025, BEREC distributed a questionnaire to all its Members to gather national experiences with the application of wholesale access obligations attached to the use of radiofrequency bands pursuant to Article 52(2) of the EECC.
