Decision of the BEREC Office Management Board laying down general implementing provisions on the conduct of administrative inquiries and disciplinary proceedings

This decision introduces new rules meant to ensure the effectiveness, efficiency and transparency of administrative inquiries, pre-disciplinary proceedings and disciplinary proceedings, in compliance with the provisions of the Staff Regulations and CEOS. Administrative inquiries, pre-disciplinary proceedings and disciplinary proceedings should be conducted in such a way as to give the person concerned the opportunity to put forward facts and circumstances relevant to the case. Furthermore, the decision takes into account developments in the case-law of the Court of Justice of the EU and of the experience acquired. The Decision is based on a model decision developed by the European Commission (EC) and adopted by EC Decision C(2022)497 of 25 January 2022. Upon the entry into force of Decision No MB/2022/07 Decision No MC/2012/3 of 25.05.2012 laying down general implementing provisions on the conduct of administrative inquiries and disciplinary proceedings is repealed and replaced by this Decision. Date of entry into force: 10 December 2022.
