BEREC advice on OPTA’s request for assistance concerning Article 25 of the Universal Service Directive.

At the beginning of January 2012, four disputes were referred to the Netherlands Independent Post and Telecommunications Authority (hereafter OPTA) under the Framework Directive. All disputes related to Article 25.2 of the Universal Service Directive.

On the basis of those disputes, on 1 June 2012, OPTA sent the BEREC Chair a request for advice concerning the interpretation of Article 25.2 USD. In its request, OPTA indicated that it had suspended its dispute resolution procedures pending BEREC’s advice.

In that respect on the 7 March 2013 BEREC approved the current advice, which was submited to OPTA.
