Public consultation on the draft BEREC Guidelines on the coordination of civil works according to Art. 5(6) of the Gigabit Infrastructure Act

During the 63rd BEREC plenary meeting (5-6 June 2025), the Board of Regulators approved the Draft BEREC Guidelines on the coordination of civil works according to Art. 5(6) of the Gigabit Infrastructure Act (BoR (25) 83) for public consultation.

Background

The new Gigabit Infrastructure Act (GIA) entered into force on 11 May 2024 and replaces the Broadband Cost Reduction Directive (BCRD) adopted in 2014. The GIA aims at facilitating and stimulating the roll-out of very high capacity networks (VHCNs) so that such networks can be rolled out faster and at a lower cost, in particular given a growing demand for faster, more reliable data intensive connectivity and as an important tool to achieve the 2030 European Union connectivity targets on gigabit connectivity. In Article 5(6) of the GIA, the co-legislators task the Body of European Regulators for Electronic Communications (BEREC) with the provision of Guidelines by 12 November 2025 on “apportioning the costs associated with the coordination of civil works”, “the criteria that the dispute settlement bodies should follow when settling disputes falling within the scope of this Article”, and “the criteria for ensuring sufficient capacity to accommodate foreseeable future reasonable needs if coordination of civil works is refused.”

Contributions should be sent preferably in English, and to facilitate processing of the responses, the comments provided should clearly refer to the specific paragraphs of the document. After submitting the contribution, you will receive an acknowledgment email.

All stakeholders are strongly encouraged to submit their contributions as early as possible. Contributions received after the above-mentioned deadline will not be taken into account.

In accordance with the BEREC policy on public consultations, BEREC will publish all contributions and a summary of the contributions, respecting confidentiality requests. Any such requests should clearly indicate information that is considered confidential and should be accompanied by a non-confidential version in case the contribution is deemed partially confidential.
