BEREC has adopted a BEREC opinion on Phase II investigation: Case DE/2013/1527

BEREC adopted a BEREC Opinion on Phase II investigation pursuant to Article 7a of Directive 2002/21/EC as amended by Directive 2009/140/EC on 15 January 2014.

On 28 November 2013, the European Commission issued its serious doubts letter addressed to the German National Regulatory Authority BNetzA considering in particular that the proposed cost-orientation remedy to be imposed on spigate Wireless in the market for wholesale voice call termination on individual mobile networks (market 7) in Germany does not ensure that customers derive maximum benefits in terms of efficient cost based termination rates.

Following its role and rules BEREC adopted its opinion, stating that the expressed serious doubts by the European Commission are justified. More specific information about the serious doubts of the European Commission and BEREC’s assessment can be found here.
